On Monday, March 30, Latisha Fisher, 35, was with her son, 20-month-old Gavriel Ortiz, in a Midtown restaurant called 5 Boro Burger, located at 80 W. 36th St. at Sixth Avenue. What was supposed to be a normal lunch turned into the complete opposite. Now the stroller with which the mother carried the boy is examined as evidence against Fischer.
According to the police, at about 2:25 p.m. she locked herself in the bathroom. It seems that a customer first tried to open the bathroom door but noticed it was locked. An employee was called but with no success, the door remained locked. When they asked the woman why she had locked the door and what was she doing in the bathroom, she allegedly placed her hand over the toddler’s mouth in order to put him to sleep.
The door was finally unlocked when an employee got ahold of the bathroom key. The boy was found lying in an unconscious state and foaming at the mouth. Chris Coffee was among the people present when the boy was taken out of the bathroom. He described that he noticed there was some agitation in the corner. When he got up to see what was happening, he saw the boy looking “, kind of unresponsive”. He then heard employees talking about the mother and how she wouldn’t come out of the bathroom, locking herself inside.
Some sources stated that when asked why she had done that, the mother responded: “The devil made me do it.”
The boy was taken to the Bellevue Hospital Center where he was pronounced “dead on arrival”. The mother was arrested and taken to the Midtown South Precinct. Another witness, Marcus Como, described how:
“The mother came out in handcuffs. She was inside the restaurant with the baby. She didn’t seem too distressed, just kind of had her head down.”
Police is now waiting for the results of the autopsy that will be released by the New York City Medical Examiner’s office. Meanwhile, officers are gathering witnesses’ statements, interviewing those close to Latisha Fisher and looking for evidence against her.
